About Process Serving in Alabama
Alabama does not require a license to serve process. Under the Alabama Rules of Civil Procedure (ARCP), any person who is at least 19 years of age and not a party to the action may serve process. Process servers in Alabama are typically appointed by the court through a standing order or individual court designation.
Service of process in Alabama is governed by ARCP Rules 4, 4.1, 4.2, and 4.3. Personal service requires delivering a copy of the summons and complaint to the individual being served. If personal service cannot be made, Alabama allows substitute service by leaving copies at the individual's dwelling or usual place of abode with a person of suitable age and discretion who resides there.
Process must be served within 120 days of the filing of the complaint. Once a process server receives the documents, they must complete service and file proof of service (return of service) within 60 days. Failure to serve within these timeframes may result in dismissal of the action without prejudice.
The average cost of process serving in Alabama ranges from $45 to $100 for routine service, with rush and same-day services costing more. Prices vary by county and complexity of the serve.
