Yes, if you serve process for compensation more than 10 times per year. California requires registration with the county clerk under Business & Professions Code §22350. Registration requires a $2,000 surety bond, fingerprinting, a criminal background check (no felony convictions), and one year of California residency. Sheriffs, attorneys, court appointees, and licensed private investigators are exempt.
Routine process service in California typically costs between $50 and $150 per serve. Fees vary significantly by county — Los Angeles and San Francisco tend to be at the higher end, while rural counties may be lower. Rush service, multiple attempts, and skip tracing add to the cost. Under CCP §583.210 and California Rules of Court 3.110(b), the summons must be served within 60 days after filing the complaint. This is one of the shortest service deadlines in the country. Failure to serve within this period can result in dismissal of the action unless the court grants an extension for good cause.
Any person 18 or older who is not a party to the action may serve process in California. However, anyone serving process for compensation more than 10 times per year must register with the county clerk under BPC §22350. Unregistered servers who exceed that threshold are operating illegally.
If personal service cannot be completed, California allows substitute service under CCP §415.20 — leaving documents at the person's home or business with a competent adult, followed by mailing. If the person cannot be located after due diligence, the court may authorize service by publication under CCP §415.50.
