How service works in Indiana

Use these steps to check the court requirements, choose a permitted service method, and keep service on track in Indiana.

1

Confirm the requirements

Confirm the court requirements that apply to your case before choosing a server.

No license, bond, or training. Appointment is the mechanism: courts appoint private process servers either specially for a case or regularly for a period of time under Trial Rule 4.12(A). A sheriff, deputy, or full-time state or municipal police officer may serve in any Indiana county by agreement under Rule 4.12(B), but no agreement is permitted with the sheriff for service in the sheriff's own county. A server who is not otherwise authorized can still effect valid service, but must prove it as a witness or by deposition and cannot recover expenses as costs.

2

Choose an allowed service method

  • Personal service
  • Leaving copy at dwelling or usual place of abode (substitute)
  • Registered or certified mail
  • Service on agent
  • Publication after diligent search
3

Request service and track the deadline

Request bids from process servers who cover your county, then track the applicable deadline.

Deadline: No fixed deadline to complete service

Frequently Asked Questions

No — Indiana issues no process server license or registration. What Indiana requires is appointment: under Trial Rule 4.12(A), personal or dwelling-house service must be issued to and served by the sheriff, a deputy, or a person specially or regularly appointed by the court. Courts can appoint a server for a single case or regularly for a period of time, and a regular appointment is how private servers work in Indiana.

Routine process service in Indiana typically costs between $50 and $150 for private servers. Sheriff service fees are approximately $28 per defendant in most counties. Rush and rural serves cost more. You can compare rates by requesting bids from multiple verified servers on the Mighty Process Server platform.

Indiana does not specify a fixed deadline to complete service in its rules of procedure. However, once served, the defendant must respond within 20 days under Trial Rule 6. Courts retain authority to dismiss for failure to prosecute with reasonable diligence. Prompt service is strongly advisable.

In a sense, yes — but with a penalty. Indiana Trial Rule 4.12(A) directs personal and dwelling-house service to the sheriff, a deputy, or a court-appointed person, and while service by someone not otherwise authorized is still effective, proof of that service must be made by that person as a witness or by deposition and no expenses are recoverable as costs. Practically, private servers obtain a special or regular court appointment.

If personal service cannot be completed, Indiana allows substitute service by leaving a copy at the defendant's usual place of abode. Service by certified or registered mail is also authorized. If the defendant cannot be located after diligent search, the court may authorize service by publication under Trial Rule 4.13.
