Sheriff/officer service — Delaware has no process server license. Under Superior Court Civil Rule 4(d), service of process is made by the sheriff to whom the writ is directed, by a deputy, or by a person specially appointed by the Court — and except in long-arm cases the Court will not make a special appointment unless the moving papers show that the sheriff returned non est inventus, that service must be made after 10:00 p.m. on a weekday, that it must be made on a weekend or holiday, or that some other exigent reason prevents sheriff service. No license, bond, or training exists, but private service requires a special appointment by the Court. Except in cases governed by 10 Del. C. §§ 3104, 3112 and 3114 — long-arm service on the Secretary of State, where appointments are made freely — a motion for a special process server must affirmatively demonstrate one non est inventus return by the sheriff, a need to serve after 10:00 p.m. on a weekday, a need to serve on a weekend or holiday, or another exigent reason the sheriff cannot or will not serve. The sheriff must be given notice of the motion and may oppose it. Subpoenas are served under Rule 45.
