How service works in Delaware

No license, bond, or training exists, but private service requires a special appointment by the Court. Except in cases governed by 10 Del. C. §§ 3104, 3112 and 3114 — long-arm service on the Secretary of State, where appointments are made freely — a motion for a special process server must affirmatively demonstrate one non est inventus return by the sheriff, a need to serve after 10:00 p.m. on a weekday, a need to serve on a weekend or holiday, or another exigent reason the sheriff cannot or will not serve. The sheriff must be given notice of the motion and may oppose it. Subpoenas are served under Rule 45.
